A BILL to amend article five, chapter eighteen of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
forty-one, relating to agricultural education programs in
secondary schools; accountability; and reimbursement of cost
by state board of education.
Be it enacted by the Legislature of West Virginia:
That article five, chapter eighteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
forty-one, to read as follows:
ARTICLE 5. COUNTY BOARD OF EDUCATION.
§18-5-41. Agricultural board of education.
(a) All agricultural education programs conducted in the
secondary schools of this state shall be on a year-round basis.
In order to secure and maintain funding for year-round
employment, each teacher involved will be required to completeand file accountability reports as deemed appropriate by the
state supervisor of agricultural education. These reports shall
be filed annually with their county board of education and the
state department of education.
(b) To implement these programs, county boards of education
shall be reimbursed by the state board of education for a minimum
of two hundred forty days of agricultural education instruction
after a five year phase-in period. During year one, the county
board of education will continue to receive a two hundred day
reimbursement; year two, a two hundred ten day reimbursement;
year three, a two hundred twenty day reimbursement; year four, a
two hundred thirty day reimbursement; year five and thereafter,
a two hundred forty day reimbursement for the agricultural
education instruction with the submission of the required
reports.
(c) Failure to submit the required reports shall result in
the loss of reimbursement for such department during the
following year. Programs currently on extended employment will
be maintained at least on their current level of employment
during the years of implementation.
NOTE: The purpose of this bill is to establish all
agricultural education programs in high schools as year-round
programs and requires the state board of education to reimburse
counties for the extra cost over a five year phase-in period.
