A BILL to amend and reenact section six-a, article two, chapter
thirty-eight of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to mechanics'
liens; granting a mechanic's lien to surveyors for materials
furnished, work done or services provided; and providing for
the perfection and preservation of certain mechanics' liens.
Be it enacted by the Legislature of West Virginia:
That section six-a, article two, chapter thirty-eight of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 2. MECHANICS' LIENS.
§38-2-6a. Lien of architect, surveyor, engineer or landscape
architect.
An architect, surveyor, engineer or landscape architect
shall have a lien for his or her compensation as provided for in
sections one through six, inclusive, of this article for all
materials furnished and all work done, or all services providedby such architect, surveyor, engineer and landscape architect as
a contractor, subcontractor, materialman, mechanic or laborer, as
the case may be. The lien shall be perfected and preserved in
accordance with, and shall otherwise be subject to, the
provisions of this article governing liens for contractors,
subcontractors, materialmen, mechanics or laborers, as the case
may be.

(NOTE: The purpose of this bill is to grant a mechanics'
lien to a surveyor for materials furnished, work done or services
provided and to clarify how such liens may be perfected and
preserved.)
