A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §61-8B-10a, relating to establishing criminal penalties for sexual relationships between teachers and students in schools in West Virginia.

Be it enacted by the Legislature of West Virginia:


ARTICLE 8B. SEXUAL OFFENSES.


§61-8B-10a. Imposition of sexual activity on a student of a school in West Virginia by a teacher.


Any teacher employed at a school in the State of West Virginia, who engages in sexual intercourse, sexual intrusion, or sexual contact, as defined in §61-8B-1 of this code, with a person who is a student at the school and has not graduated high school is guilty of a felony and, upon conviction thereof, shall be fined not more than $5,000 or imprisoned in a state correctional facility for not less than one nor more than five years or both fined and imprisoned.

 

NOTE: The purpose of this bill is to establish criminal penalties for sexual intercourse, sexual intrusion or sexual contact with a school student who has not finished high school, by a teacher of the school.
