A BILL to amend and reenact section six, article three, chapter
eighteen of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to interpretation
of school laws by the state superintendent of schools.
Be it enacted by the Legislature of West Virginia:
That section six, article three, chapter eighteen of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 3. STATE SUPERINTENDENT OF SCHOOLS.
§18-3-6. Interpretation of school laws and rules of state board
of education.
At the request in writing of any citizen, teacher, school
official, county or state officer, the state superintendent of
schools shall give his interpretation of the meaning of any part
of the school law or of the rules of the state board of
education.
At the request in writing of any citizen, teacher,
school official, county or state officer the state superintendentshall request from the state attorney general an opinion of any
part of school law.
NOTE: The purpose of this bill is to remove the
interpretation of school law from the state superintendent of
schools and to have school law interpreted by the state attorney
general.
