A BILL to amend article fourteen, chapter seventeen-c of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section six-a, relating to prohibiting anyone from riding unrestrained in the back of an open vehicle; and providing a misdemeanor penalty.

Be it enacted by the Legislature of West Virginia:
That article fourteen, chapter seventeen-c of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section six-a, to read as follows:
ARTICLE 14. MISCELLANEOUS RULES.

§17C-14-6a. Transportation of unrestrained persons in the back of open vehicles prohibited.

Any person riding unrestrained in the back of an open vehicle is guilty of a misdemeanor, and, upon conviction, shall be fined fifty dollars.
Any operator of a motor vehicle who permits any person to ride unrestrained in the back of an open vehicle is guilty of a misdemeanor, and, upon conviction, shall be fined fifty dollars.



NOTE: The purpose of this bill is to prohibit persons from riding unrestrained in the back of open vehicles. The bill further makes a violation a misdemeanor subject to fine.
