A BILL making a supplementary appropriation of public moneys out
of the treasury from the balance of moneys remaining as an
unappropriated balance in the lottery net profit fund to the
state department of education and the arts -- office of the
secretary, account no. fund 4800, fiscal year 1998,
organization 0453, all supplementing and amending the
appropriation for fiscal year ending the thirtieth day of
June, one thousand nine hundred ninety-eight.
Whereas, The governor submitted to the Legislature the
executive budget document, dated January 14, 1998, which included
a statement of the lottery net profit fund, setting forth therein
the cash balance and investments as of July 1, 1997, and further
included the estimate of revenues for fiscal year 1997-98, less
net appropriation balances forwarded and regular appropriations for fiscal year 1997-98.
Whereas, It appears from the governor's executive budget
document there now remains an unappropriated balance in the state
treasury which is available for appropriation during fiscal year
ending the thirtieth day of June, one thousand nine hundred
ninety-eight; therefore
Be it enacted by the Legislature of West Virginia:
That chapter five, acts of the Legislature, regular session,
one thousand nine hundred ninety-seven, known as the "budget
bill", be supplemented and amended by adding to Title II, section
four thereof, the following:

Sec. 4. Appropriations from lottery net profits.

Any unexpended balance remaining in the appropriation for
Culture and History - Cultural Center Capital Outlay (fund 4800,
activity 687), Culture and History - State Museum Capital Outlay
(fund 4800, activity 688), Culture and History - State Theater
Capital Outlay (fund 4800, activity 690), Library Commission -
Infomine Network (fund 4800, activity 696), Educational
Broadcasting Authority - Relocation Expenses (fund 4800, activity
697) and Educational Broadcasting Authority - 600 Capitol Street
(fund 4800, activity 700) at the close of fiscal year 1997-98, is
hereby reappropriated for expenditure during fiscal year 1998-99.
The purpose of this bill is to supplement the budget act for
fiscal year ending the thirtieth day of June, one thousand nine
hundred ninety-eight, by providing for a new item of appropriation to be established therein to appropriate lottery
net profit funds in the amount of nine hundred sixty-seven
thousand four hundred dollars for Culture and History - Cultural
Center Capital Outlay, two million five hundred thousand dollars
for Culture and History - State Museum Capital Outlay; one
hundred twelve thousand dollars for Culture and History - State
Theater Capital Outlay; two million four hundred sixteen thousand
four hundred sixty-eight dollars for Library Commission -
Infomine Network; five hundred fifty thousand dollars for
Educational Broadcasting Authority - Relocation Expenses; and six
hundred thousand dollars for Education Broadcasting Authority -
600 Capital Street for expenditure during fiscal year one
thousand nine hundred ninety-eight.
