SENATE CONCURRENT RESOLUTION NO. 33

Requesting the Joint Committee on Government and Finance to conduct
an interim committee study relating to the marking of high- voltage power lines across interstate highways.
Whereas, There exists a present statute relating to the Public
Service Commission which requires that certain high voltage power
lines crossing the Ohio River be marked and made visible to any
aircraft operating in the area; and
Whereas, Aircraft often use interstate highways for directions
when operating under visual flight regulations; and
Whereas, The presence of such lines near interstate highways
presents a serious danger to aircraft operating in the area; and
Whereas, Interstate highways are sometimes used by small
aircraft for emergency landings; and
Whereas, There may exist a present need for similar marking of
high-voltage power lines crossing interstate highways in order to
make them visible to any aircraft operating in the area; therefore,
be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to review, examine and study, with the assistance of the
Public Service Commission, during the interim of the Legislature,
whether lines erected over and across interstate highways, or near
other relevant landmarks, should be regulated with regard to
dangers posed thereby to aircraft and, therefore, appropriately
marked and made visible; and be it
Further Resolved, That the Joint Committee on Government and
Finance make a report to the regular session of the Legislature, 2000, ofn
its findings, conclusions and recommendations, together with a drafts
of any legislation necessary to effectuate its recommendations to the
Legislature at the
beginning of the 2000
Regular
Session; ;
and, be it
Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from the legislative appropriations to the Joint Committee on
Government and Finance.
