A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §19-23-30; to amend said code by adding thereto a new section, designated §29-22-31; to amend said code by adding thereto a new section, designated §29-22A-20; and to amend said code by adding thereto a new section, designated §29-22C-35, all relating to redirecting certain racing and gaming revenues from greyhound development and racing funds to the State Road Fund.

Be it enacted by the Legislature of West Virginia:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §19-23-30; that said code be amended by adding thereto a new section, designated §29-22-31; that said code be amended by adding thereto a new section, designated §29-22A-20; and that said code be amended by adding thereto a new section, designated §29-22C-35, all to read as follows:

CHAPTER 19. AGRICULTURE.

ARTICLE 23. HORSE AND DOG RACING.

§19-23-30.  Redirecting amounts deposited into Greyhound Breeding Development Fund and amounts for purse funds to be deposited into State Road Fund effective 2016.

(a) On and after the effective date of this section, any amounts otherwise required under any provision of this article to be deposited into the West Virginia Greyhound Breeding Development Fund shall, in lieu thereof, be deposited into the State Road Fund established under section one, article three, chapter seventeen of this code.

(b) On and after the effective date of this section, any amounts otherwise required under any provision of this article to be deposited into any fund or paid for the purpose of funding purses, awards or provide any other funding for greyhound races shall, in lieu thereof, be deposited into the State Road Fund established under section one, article three, chapter seventeen of this code.

CHAPTER 29. MISCELLANEOUS BOARDS AND OFFICERS.

ARTICLE 22. STATE LOTTERY ACT.

§29-22-31.  Redirecting amounts deposited into Greyhound Breeding Development Fund and amounts for purse funds to be deposited Into State Road Fund effective 2016.

(a) On and after the effective date of this section, any amounts otherwise required under any provision of this article to be deposited into the West Virginia Greyhound Breeding Development Fund shall, in lieu thereof, be deposited into the State Road Fund established under section one, article three, chapter seventeen of this code.

(b) On and after the effective date of this section, any amounts otherwise required under any provision of this article to be deposited into any fund or paid for the purpose of funding purses, awards or provide any other funding for greyhound races shall, in lieu thereof, be deposited into the State Road Fund established under section one, article three, chapter seventeen of this code.

ARTICLE 22A. RACETRACK VIDEO LOTTERY.

§29-22A-20.  Redirecting amounts deposited into Greyhound Breeding Development Fund and amounts for purse funds to be deposited into State Road Fund effective 2016.

(a) On and after the effective date of this section, any amounts otherwise required under any provision of this article to be deposited into the West Virginia Greyhound Breeding Development Fund shall, in lieu thereof, be deposited into the State Road Fund established under section one, article three, chapter seventeen of this code.

(b) On and after the effective date of this section, any amounts otherwise required under any provision of this article to be deposited into any fund or paid for the purpose of funding purses, awards or provide any other funding for greyhound races shall, in lieu thereof, be deposited into the State Road Fund established under section one, article three, chapter seventeen of this code.

ARTICLE 22C. WEST VIRGINIA LOTTERY RACETRACK TABLE GAMES ACT.

§29-22C-35.  Redirecting amounts deposited into Greyhound Breeding Development Fund and amounts for purse funds to be deposited into State Road Fund effective 2016.

(a) On and after the effective date of this section, any amounts otherwise required under any provision of this article to be deposited into the West Virginia Greyhound Breeding Development Fund shall, in lieu thereof, be deposited into the State Road Fund established under section one, article three, chapter seventeen of this code.

(b) On and after the effective date of this section, any amounts otherwise required under any provision of this article to be deposited into any fund or paid for the purpose of funding purses, awards or provide any other funding for greyhound races shall, in lieu thereof, be deposited into the State Road Fund established under section one, article three, chapter seventeen of this code.

NOTE: The purpose of this bill is to redirect all revenues derived from racing and gaming that are now deposited into greyhound development funds to be deposited into the State Road Fund.
