A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §18-9D-22, relating
to authorizing the School Building Authority to award grants
or moneys to county and local library boards in connection
with public library construction projects, from any funds
appropriated by the Legislature; defining "public library
construction project"; requiring a demonstration of county or
local effort and fund-raising before grants or moneys may be
awarded for a public library construction project; describing
what costs may be paid by the School Building Authority;
setting forth additional powers of authority concerning
construction projects; and authorizing the authority to
establish guidelines and procedures for the award of grants or
moneys for public library construction projects.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §18-9D-22, to read as
follows:
ARTICLE 9D. SCHOOL BUILDING AUTHORITY.
§18-9D-22. Public library construction projects.
__________(a) In addition to all other powers and authority granted to
the authority under this article, the authority has the power and
authority to award grants and moneys to any county or local library
board in the state for a public library construction project or
projects from any funds appropriated by the Legislature for those
purposes. For purposes of this section, a "public library
construction project" means a project with a cost of greater than
$1 million for the new construction, expansion or major renovation
of facilities, buildings or structures for public library purposes,
including the acquisition of land for current or future use in
connection with the public library construction project, new or
substantial upgrading of existing equipment, machinery or
furnishings, and the installation of utilities or other similar
items related to making the public library construction project
operational. No grant or moneys may be awarded under this section
unless the authority determines that the county or local library
board, or one or more organizations or groups affiliated with the
county or local library board, has raised or will raise funds at
the county or local level, in an amount the authority in its discretion deems reasonable and appropriate to demonstrate
substantial county or local effort in support of the public library
construction project. The local or county funds required to be
raised by the county or local library board, or one or more
organizations or groups affiliated with the county or local library
board, may be raised before or after the effective date of this
section.
__________(b) Any grants or moneys awarded by the authority under this
section to a county or local library board may be used to pay for
any and all costs of or associated with the public library
construction project, including the cost of construction,
expansion, renovation, repair and safety upgrading of facilities,
buildings and structures for public library purposes, the cost of
land, equipment, machinery, furnishings, installation of utilities
and other similar items related to making the public library
construction project operational, and the cost of financing,
interest during construction, professional service fees and all
other charges or expenses necessary, appurtenant or incidental to
the foregoing.
__________(c) In addition to the power and authority to award grants and
moneys to any county or local library board in the state for a
public library construction project, the authority has all powers
set forth in sections three and section twenty of this article with
respect to public library construction projects.
__________(d) The authority may establish guidelines and procedures for
the award of grants or moneys for public library construction
projects, to promote the intent and purposes of this section and
assure the prudent and resourceful expenditure of state funds for
public library construction projects under this section.
NOTE: The purpose of this bill is to authorize the School
Building Authority to award grants and moneys to county or local
library boards for public library construction projects, based on
a demonstration of substantial county or local effort as evidenced
by county or local fund-raising, from any moneys that may be
appropriated by the Legislature to the School Building Authority
for those purposes.
This section is new; therefore, it has been completely
underscored.
