A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §3-8-5g, relating to
maintaining campaign financial records; setting forth time
lines for maintaining records; and providing penalties for
violations.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §3-8-5g, to read as
follows:
ARTICLE 8. REGULATION AND CONTROL OF ELECTIONS.
§3-8-5g. Maintaining of all campaign related financial records and
receipts.
A candidate, financial agent or treasurer shall maintain all
campaign related financial records and receipts until a period of
two years following the filing of each related financial report, which shall be available to the Secretary of State or county clerk
for the purposes of an audit as provided in section seven, article
eight, chapter three of this code. Anyone who willfully fails to
maintain such records is guilty of a misdemeanor and, upon
conviction thereof, shall be fined not less than five hundred
dollars, or imprisoned in jail for not more than one year, or both
fined and imprisoned.
NOTE: The purpose of this bill is to establish a time frame
for maintaining campaign records and receipts.
