A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §16-5B-10a, relating
to requiring hospitals to disclose the results of clinical
trials to physicians and the public.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §16-5B-10a, to read as
follows:
ARTICLE 5B. HOSPITALS AND SIMILAR INSTITUTIONS.
§16-5B-10a. Information that must be disclosed for continuing
licensure.
For the purposes of this section:
A "clinical trial" is a study that determines whether new
drugs, treatments or medical procedures are safe and effective on
humans.
It is the policy of the State of West Virginia that any
hospital, including university affiliated hospitals, research
facilities or other similar institutions, or entities required to
be licensed under this article and conducting clinical trials shall
disclose to the public the results of any clinical trial conducted
within three months of the conclusion of the clinical trial.
A hospital or university institutional review board may not
approve clinical trials unless the results are made available to
physicians and the public as herein provided.
NOTE: The purpose of this bill is to
require hospitals to
disclose the results of clinical trials to physicians and the
public.
