HOUSE JOINT RESOLUTION NO. 16

Proposing an amendment to the Constitution of the State of West
Virginia, amending section 52, article VI thereof, relating to
providing that counties may design license plates and receive
revenue from the sale of the license plates by the state;
numbering and designating such proposed amendment; and
providing a summarized statement of the purpose of such
proposed amendment.
Resolved by the Legislature of West Virginia, two thirds of
the members elected to each house agreeing thereto:
That the question of ratification or rejection of an amendment
to the Constitution of the State of West Virginia be submitted to
the voters of the state at the next general election to be held in
the year two thousand six, which proposed amendment is that section
52, article VI thereof be amended, to read as follows:
ARTICLE VI. LEGISLATURE, ETC.
§52. Revenues Applicable to Roads.
Revenue from gasoline and other motor fuel excise and license
taxation, motor vehicle registration and license taxes, and all
other revenue derived from motor vehicles or motor fuels shall,
after the deduction of statutory refunds and cost of administration
and collection authorized by legislative appropriation, be
appropriated and used solely for construction, reconstruction,
repair and maintenance of public
highways, and also the payment of
the interest and principal on all road bonds heretofore issued or
which may be hereafter issued for the construction, reconstruction
or improvement of public highways, and the payment of obligations
incurred in the construction, reconstruction, repair and
maintenance of public highways: Provided, That each county of this
state is authorized to design a county registration plate,
depicting the county, to be sold by the state, and in such event of
the sale of a county-designed license plate, the state shall remit
any additional fee required to be paid above the fee for a standard
registration plate, to the county whose designed registration plate
was sold.
Resolved further, That in accordance with the provisions of
article eleven, chapter three of the Code of West Virginia, 1931,
as amended, such proposed amendment is hereby numbered "Amendment
No. 1" and designated as the "County License Plate Authorization Amendment" and the purpose of the proposed amendment is summarized
as follows: "To authorize each county to design a county license
plate representing the particular county and providing that the
state offer such plates for sale and remit any additional fee
received for such sale."
NOTE: The purpose of this amendment is to allow each county to
design a license plate depicting the county, to be sold by the
state and allowing any additional fee for the plate to be remitted
to the county.
