A BILL to amend the Code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §18-9A-15a, relating
to
allocations to counties with low enrollment for capacity
building; and providing
a process for allocations to school
districts with low enrollment.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §18-9A-15a, to read as
follows:
ARTICLE 9A. PUBLIC SCHOOL SUPPORT.
§18-9A-15a. Allowance for low enrollment.
(a) The Legislature may make an appropriation to the
Department of Education for allocations to counties with low
enrollment for capacity building.
(b) A county is eligible for consideration for an allocation from the amount appropriated if the State Superintendent determines
that:
(1) The county has less than one thousand four hundred
students in net enrollment;
(2) The county has a lack of capacity to provide direct
services to students mandated by state law or State Board policy;
and
(3) The county has made a reasonable local effort to provide
direct services to students mandated by state law or State Board
policy.
(c) The State Superintendent shall receive any applications
for an allocation annually during a period of time designated by
the State Superintendent.
(d) The State Superintendent shall make allocations to
eligible counties as he or she determines appropriate.
(e) Nothing in this section shall be construed to require any
specific level of funding by the Legislature.
NOTE: The purpose of this bill is to provide a procedure to
allocate appropriations to counties with low enrollment for
capacity building.
