A BILL to repeal section three, article two, chapter fifty-seven
of the code of West Virginia, one thousand nine hundred
thirty-one, as amended, relating to statements by an accused
upon a legal examination.
Be it enacted by the Legislature of West Virginia:
ARTICLE 2. WRITINGS AND STATEMENTS OF PRIVATE PERSONS.
§1. Repeal of section relating to statement by accused upon legal
examination.
Section three, article two, chapter fifty-seven of the code of
West Virginia, one thousand nine hundred thirty-one, as amended, is
hereby repealed.
NOTE: The purpose of this bill is to delete a section of the
article on writings and statements of private persons and statements by an accused upon trial in a criminal prosecution. The
reason for the statute is obsolete, as there are constitutional
provisions protecting individuals from being compelled to testify.
