A BILL to amend the code of West Virginia, 1931, as amended, by
adding thereto a new section, designated §7-1-14, relating to
authorizing county commissions to implement a hazardous road
program.
Be it enacted by the Legislature of West Virginia:
That the code of West Virginia, 1931, as amended, be amended
by adding thereto a new section, designated §7-1-14, to read as
follows:
ARTICLE 1. COUNTY COMMISSIONS GENERALLY.
§7-1-14. Hazardous road program.
Every county commission shall implement a hazardous road
program that allows citizens to submit information on roads within
the county that are in need of repair or improvement by
construction to reduce or eliminate a road hazard or hazardous
condition. The information submitted by the citizen shall include a description of the road hazard, why the road hazard needs to be
corrected and where on the road the hazard is located.
The county commission shall review any information submitted
on the hazardous roads within the county and compile a prioritized
list of roads in need of repair or improvement.
The county commission shall submit a priority list of
hazardous roads that need to be repaired within the county
quarterly to the commissioner of the division of highways.
NOTE: The purpose of this bill is to authorize county
commissions to implement a hazardous road program whereby citizens
can submit information on hazardous roads within the county. The
county commission shall prioritize the roads in need of repair and
submit a list to DOH each quarter.
