A BILL to amend the code of West Virginia, 1931, as amended, by
adding thereto a new article, designated §9A-1A-1, §9A-1A-2,
§9A-1A-3, §9A-1A-4 and §9A-1A-5,
all relating to establishing
a one-dollar check-off contribution from a taxpayer's refund
for providing free phone cards to West Virginia citizens in
combat in the armed forces of the United States and their
families.
Be it enacted by the Legislature of West Virginia:
That the code of West Virginia, 1931, as amended, be amended
by adding thereto a new article, designated §9A-1A-1, §9A-1A-2,
§9A-1A-3, §9A-1A-4 and §9A-1A-5, all
to read as follows:
ARTICLE 1A. VOLUNTARY COMBAT PHONE CARD CHECK-OFF PROGRAM.
§9A-1A-1. Legislative intent.
It is in the public interest to support members of the
military and their families in the time of war. Citizens of West Virginia who are involved in military combat in the armed forces of
this country endure many sacrifices including long absences from
home and family. Providing a means to support communication and
contact between citizens in combat and their family members
contribute to the national good. The intent of this article is to
provide for the distribution of free phone cards to citizens of
this state serving in combat in the armed forces of this country
and their immediate families.
The financing of this program is derived from a voluntary
check-off and contribution designation on state personal income tax
return forms of one dollar of a taxpayer's refund.
§9A-1A-2. Voluntary check-off designation.
(a) Each West Virginia individual income tax return form shall
contain a designation as follows:
West Virginia Voluntary Combat Phone card Check-Off Program.
Check ( ) if you wish to designate $1 or more of your tax
refund for this program. If joint return, check ( ) if spouse
wishes to designate $1 or more.
(b) Each individual taxpayer desiring to contribute to the
voluntary combat phone card program may designate by placing an "X"
in the appropriate box on the state income tax return form. His or
her contribution shall be credited to the program.
§9A-1A-3. Contributions credited to special fund.
The tax department shall determine by the first day of July of each year the total amount designated pursuant to this legislation
and shall report such amount to the state treasurer who shall
credit such amount to a special division of veterans' affairs
combat phone card program fund.
§9A-1A-4. Use of funds.
The funds shall be used for the purpose of providing telephone
prepaid phone cards to citizens of this state serving in combat in
the armed forces of this country and their immediate families as
determined by the director of the division of veterans' affairs.
The director shall on the fifteenth day of January each year
furnish the Legislature with a report stating the amount of money
that has been provided and how such moneys have been expended.
§9A-1A-5. Effective date.
This legislation shall take effect on the first day of
January, two thousand five, and shall apply to tax return forms
filed thereafter.
NOTE: The purpose of this bill is to establish a one-dollar
check-off contribution from a taxpayer's refund for providing free
phone cards to West Virginia citizens in combat in the armed forces
of the United States and their families.
