[Originating in the Committee on Energy, Industry, and Mining; reported on February 21, 2020]

A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §22-6A-7A, relating to modifications of well work permits issued by the Department of Environmental Protection’s Office of Oil and Gas.

Be it enacted by the Legislature of West Virginia:


§22-6A-7a. Modifications of permits.

A permit issued pursuant to this article may be modified to address changes to the permit so long as the secretary determines that the modification fully meets all applicable requirements and would be consistent with the issuance of the original permit.

The secretary may deny the application for a permit modification as outlined for new permits under this article.

A request to modify a permit issued pursuant to this article shall be on forms prescribed by the secretary and accompanied by a fee of $2,500.

 

NOTE: The purpose of this bill is to create a statutory fee for the modifications to permits issued by the Department of Environmental Protection’s Office of Oil and Gas.
