SENATE CONCURRENT RESOLUTION NO. 67

Requesting the Joint Committee on Government and Finance study
potentially establishing criminal penalties for the
interference with medical treatment of railroad employees,
including charges that may be filed, fines for violations of
criminal provisions and possible confinement in a
correctional facility.
Whereas, Protecting the health and safety of all workers in
West Virginia is of paramount importance to the Legislature; and
Whereas, It is against the public policy of the State of
West Virginia to deny, delay or in any way interfere with medical
treatment or first-aid treatment to anyone injured while at their
place of employment; and
Whereas, The economy of West Virginia is vitally dependent
upon rail service for transportation of goods; and
Whereas, Those persons employed in the railroad industry are
often called upon to perform duties that are, at times, dangerous
and can result in injury. Medical treatment for these
individuals with such injuries has been, at times, interfered
with; and therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to study potentially establishing criminal penalties
for the interference with medical treatment of railroad
employees, including charges that may be filed, fines for
violations of criminal provisions and possible confinement in a
correctional facility; and, be it
Further Resolved, That the Joint Committee on Government and
Finance shall consult with the Federal Railroad Administration
and representatives of the railway industry, including, but not
limited to, railway company personnel and employees; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 2005,
on its findings, conclusions and recommendations, together with
drafts of any legislation necessary to effectuate its
recommendations; and, be it
Further Resolved, That the expenses necessary to conduct
this study, to prepare a report and to draft necessary
legislation be paid from legislative appropriations to the Joint
Committee on Government and Finance.
